Introduction
Welcome to Parts Corp. These Terms and Conditions govern your use of www.partscorp.co.za and our services. By accessing or using our website, you agree to be bound by these Terms and Conditions, which are subject to the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act") and the Consumer Protection Act 68 of 2008 ("CPA") of South Africa.
Definitions
"Consumer" means any natural person or juristic person with an annual turnover or asset value below R2 million who purchases products from our website.
"Goods" means the products and services offered for sale on our website.
"Service Provider" refers to Parts Corp and its legal representatives, successors, and assigns.
Electronic Communications
When you visit our website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Products and Pricing
All products are subject to availability. We reserve the right to discontinue any product at any time. Prices for products are subject to change without notice. Unless otherwise indicated, prices displayed on our website are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) at the current rate.
We strive to provide accurate product descriptions and pricing information; however, we do not warrant that product descriptions or prices are accurate, complete, reliable, or error-free. If we discover an error in the price of products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.
Orders and Payment
When placing an order, you are making an offer to purchase the products you have selected. We reserve the right to accept or reject your offer for any reason, including unavailability of stock, error in pricing or product description, or concerns about the authenticity of your order.
Payment can be made using the methods specified on the website. All credit/debit card payments are subject to validation checks and authorization by your card issuer. If your card issuer refuses to authorize payment, we will not be liable for any delay or non-delivery of your order.
Delivery and Risk
We will arrange for the delivery of products to the address specified in your order. Delivery times are estimates only and not guaranteed. The risk in the products shall pass to you upon delivery. You are responsible for inspecting the products upon delivery and reporting any damages or defects within 7 days.
Cancellation, Returns, and Refunds
In accordance with the CPA, you have the right to cancel your order:
- Within 7 days of receiving the goods (for any reason)
- Within 10 business days of placing an order for digital content (before downloading)
To cancel an order, please contact our customer service team at orders@partscorp.co.za. Returned items must be in their original condition and packaging. We will refund the purchase price, excluding the cost of delivery, within 30 days of receiving the returned goods.
This cancellation right does not apply to:
- Products that have been customized for you
- Sealed products that are not suitable for return due to health protection or hygiene reasons, if unsealed
- Digital content after you have started to download or stream it
Warranties and Guarantees
In accordance with the CPA, we warrant that our products:
- Are reasonably suitable for the purpose for which they are intended
- Are of good quality, in good working order, and free from defects
- Will be usable and durable for a reasonable period of time
- Comply with applicable standards and regulations
If a product is defective or fails to meet these standards within 6 months after delivery, you may return it for repair, replacement, or refund.
Limitation of Liability
To the extent permitted by applicable law, Parts Corp will not be liable for any indirect or consequential losses, including but not limited to loss of profit, revenue, anticipated savings, data, goodwill, or business opportunity.
Our liability for any claim arising from these Terms and Conditions shall not exceed the purchase price of the products giving rise to the claim. Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
Intellectual Property
All content included on our website, such as text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Parts Corp or its content suppliers and is protected by South African and international copyright laws. The compilation of all content on this site is the exclusive property of Parts Corp and is protected by copyright laws.
Dispute Resolution
Any dispute arising from these Terms and Conditions shall first be resolved through good faith negotiations. If the dispute cannot be resolved through negotiations, either party may refer the dispute to the National Consumer Commission, an appropriate industry ombud accredited under the CPA, or the South African courts.
Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. You agree to submit to the non-exclusive jurisdiction of the South African courts.
Changes to These Terms
We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Such changes will be effective immediately upon posting on the website. Your continued use of the website following any changes indicates your acceptance of the new Terms and Conditions.
